General terms and conditions for the contracting of travel services


1. PURPOSE

These terms and conditions govern the use of www.carameltrail.com, owned by CARAMELTRAIL, S.L. (hereinafter, “Carameltrail”), and outline the provision of travel services, including package trips and other tourist services.

Carameltrail is a Spanish travel agency for which it has the necessary title license granted by the Spanish Government (C.I.C.M.A num. 2642), Registered in the Commercial Register – Volume 29146, Folio 120, Inscription 1, Sheet M-524759, with Company Tax Identity Number. B-86338654.

Acceptance of these terms and any specific conditions established for contracted services is required upon booking.

Tour packages must have a minimum duration of 7 nights and include accommodation, excursions, and transportation. A minimum of one excursion in each overnight destination with a duration of 2 or more nights must be included in your package.

2. PRICES

The price of services and package trips will include all items mentioned in the “Travel Document” provided upon booking. Carameltrail endeavors to maintain quoted prices but reserves the right to pass on any cost increase due to factors beyond its control, such as fluctuations in transportation costs or government action. Any modifications to the itinerary may require a price revision.

Carameltrail quotes prices for the tour per person or for a group of travelers in Euros. This depends on the number of travelers or arrangements of the group. The final price and the services on the tour are available for the customer to review on the trip proposal before proceeding to payment.

Carameltrail offers comprehensive, all-inclusive travel packages, ensuring that your trip cost covers all accommodations, transportation, breakfasts, personalized tours, unique experiences, VAT, and additional services. We present a complete price for your journey without an itemized breakdown of each component. Our quoted prices include our service fees and IVA (VAT), except Tourism Taxes, which will be charged separately. All Carameltrail trips are quoted and charged in Euros.

3. PAYMENT TERMS

To secure a booking, a deposit of 25% of the total cost of the trip is required. If the cost of prepayment services exceeds this deposit, Carameltrail may request an additional amount.

Full payment for all services and itineraries is required 40 days before arrival. For bookings made within 40 days of departure, immediate full payment is required.

Payments can be made via Credit Card (American Express, Visa, or Mastercard) or Bank Transfer, with booking confirmation issued upon receipt of payment.

By accepting our Terms and Conditions, you agree that Carameltrail cannot be held liable for your insurance policy’s rejection to refund your reservation. The choice of insurance policy is your sole responsibility.

Additionally, it is important to note that if full payment is not received within the stipulated timeframe, it will be understood that the client has canceled the trip. In such cases, our “Cancellation Policy” will apply. This includes the automatic cancellation of the reservation without prior agreement from the client if there is any outstanding balance due to Carameltrail after the final payment due date, as well as situations where extra services have been requested but not yet paid for.

4. CANCELLATION POLICY

Cancellations by the traveler will result in a retention of 25% of the trip’s total cost (trip deposit). This fee increases to 75% for cancellations between 30 and 15 days before the trip and 100% for less than 15 days.

Non-refundable expenses such as tickets for transportation or events may incur a 100% cancellation fee. Accommodation and airline tickets follow the refund policies of the respective properties and carriers.

No refund will be made for the services not used voluntarily by the traveler.

Carameltrail recommends travel insurance to mitigate potential losses.

Carameltrail cannot be held responsible for cancellations due to force majeure or unforeseen events beyond reasonable control. Carameltrail cannot be held liable for your insurance policy’s rejection to refund your reservation.

Changing the dates of your trip: Note that postponements or changing the dates of your trip are classified as a cancellation, and the cancellation policy above will apply in these cases.

Reducing the number of travelers: Removing a traveler from a trip before the final payment due date will result in the loss of deposit for that traveler. This may result in a higher per-person price for the remaining travelers. Carameltrail will inform you of the pricing implications before you confirm the removal of a traveler. If the removal is requested after the final payment due date, the full amount due for that traveler must be paid.

5. MODIFICATION POLICY

Carameltrail offers flexibility in modifying booked trips. Changes in dates, services, or traveler numbers may result in cost recalculations. Any increased expenses due to these changes will be communicated, and no charges will be made without the traveler’s consent.

6. PASSPORTS, VISAS, TRAVEL DOCUMENTS & DETAILS

Travelers are responsible for obtaining their proper travel documents and enquiring at the relevant consulate or visa agency whether or not visas and/or passports are required to enter or leave a destination within your trip package.

Travelers must carry a passport valid for at least six months beyond the final day of their trip package, and your passport has at least four pages free of stamps, marks, or visas.

Visas are not required for American or Canadian citizens to visit Spain, Portugal, or Morocco (the destinations offered by Carameltrail). You agree that any penalties, surcharges, fees, and/or expenses associated with failure to meet legal passport and visa requirements are to be covered by yourself (the Customer).

Customers are responsible for ensuring that Carameltrail receives the correct name spelling(s), address(es), email(s), and other relevant contact information for themselves and all of those traveling with you included in a Carameltrail booking. Information provided must be as stated on each traveler’s passport. You agree that any penalties, surcharges, fees, and expenses associated with the incorrect data you provided are to be covered by yourself (the Customer).

Any name changes, including spelling corrections, may cancel your airline reservations and require rebooking. Rebooked reservations are based on availability and priced at the rebooking time. Any change or rebooking fees associated with this name change will be your responsibility (the Customer).

7. CLAIMS

Travelers are obliged to report any contract discrepancies during the trip. Post-trip complaints will be addressed to provide satisfactory resolutions.

8. LIABILITIES

Carameltrail is liable for fulfilling the travel services outlined in the Travel Document, barring shortcomings due to the traveler’s actions or force majeure. Compensation for non-fulfillment of services will be subject to international conventions.

9. LAW & JURISDICTION

Disputes will be governed by Spanish Law and subject to the jurisdiction of Spanish courts.
